INTERPRETATION 1. www.coollogisticsconference.com and Cool Logistics are products jointly owned and operated by Next Level Information Ltd (‘NLI’) and Freshwater Logistics Ltd (‘FWL’). Freshwater Logistics Ltd 2. ‘Material’ means data or information in any format, including without limitation text, images, photographs, graphics, video or sound material whether existing at the time of registration or not, published on www.coollogisticsconference.com, whether copyright of Cool Logistics or of a third party and which is communicated or transmitted to the User in using www.coollogisticsconference.com. 3. ‘Personal Information’ means Personal Data as defined in the Data Protection Act 1998 (as amended) 4. ‘Services’ means, where applicable, any services provided by www.coollogisticsconference.com 5. ‘User’ means any person who accesses or uses www.coollogisticsconference.com A. INTRODUCTION 1. By accessing or using www.coollogisticsconference.com the User acknowledges and agrees to be bound by these Terms and Conditions. 2. Cool Logistics grants the User a non-exclusive personal licence to view the Material on www.coollogisticsconference.com for personal and non-commercial use. Cool Logistics may vary the terms of the licence at any time. 3. Each User may be allocated a unique user name and password for the authorised use of the User only. If so, these are not transferable, and the User shall keep them strictly confidential and secure. The User should notify Cool Logistics immediately if any unauthorised use comes to its attention. 4. Where Clause 3 applies, the User shall indemnify Cool Logistics against any unauthorised use of his/her user name and password, including use by a third party where the User has allowed or facilitated that third party to have access to any Material, however so received. 5. The User shall indemnify Cool Logistics against all costs, claims, demands or expenses incurred by or made against Cool Logistics or www.coollogisticsconference.com as a result of any breach of these Terms and Conditions or howsoever arising. B. CONDITIONS OF USE OF MATERIAL 1. The User may download Material electronically, print and make copies of these for his/her own personal and non-commercial use only. This does not include downloading, storing, transmitting, displaying, copying or distributing the Material, or extracts from it, in a structured manner or creating a database in any form comprising all or part of the Material. C. DATA PROTECTION AND PRIVACY POLICY Cool Logistics takes the privacy of its Users seriously. Please refer to our Privacy Policy for full details. D. LIABILITY 1. To the extent permitted by law Cool Logistics, its agents or representatives shall have no liability whatsoever to the User for any direct, indirect or consequential loss or special loss or damage, cost or expense suffered or incurred by the User (whether arising in tort, contract or otherwise, and whether arising from the negligence, breach of contract, defamation, infringement of copyright or other intellectual rights) caused by use of www.coollogisticsconference.com or from the negligence of its employees or agents or licensors, and whether asserted against Cool Logistics, www.coollogisticsconference.com or against any third party in relation to its use. 2. Cool Logistics does not make any representation or give any warranty, either express or implied: 2.1 In relation to any information, goods or services offered, accessed or obtained through www.coollogisticsconference.com; 2.2 In relation to warrantees of title, non infringement of copyright or patent rights of others, merchantability, or fitness or suitability for any purpose; 2.3 For the content, accuracy, integrity, lawfulness or otherwise of information on websites over which Cool Logistics has no control; 2.4 As to the suitability of the information and data on www.coollogisticsconference.com for any particular purpose 2.5 That the information and data on www.coollogisticsconference.com site is free of infection by computer viruses or other contamination. 3. I. CONFERENCE PAYMENT, REFUND AND CANCELLATION POLICY 1. Cancellations received in writing by 20 August 2010 will be refunded less a €150 administration fee. Cancellations received after 20 August 2010 will not be refunded. Substitutions are welcome at any time. You will be refunded, less administration fee, no more than 30 days after we receive and acknowledge your written cancellation notice. 2. It may be necessary for reasons beyond the control of the Organiser to alter the content, timings or venue. Cool Logistics Conferences does not accept liability for any transport disruption or individual transport delays and in such circumstances the normal cancellation restrictions apply. 3. Payment must be made in advance. If payment is not received before the conference, delegates will be asked to make payment upon arrival at the event at the registration desk with a corporate or personal credit card.
